The US Commodity Futures Trading Commission (CFTC) is preparing to discuss crypto regulation, artificial intelligence and prediction markets at the first meeting of its Innovation Advisory Committee on August 20. The move comes as the Senate has delayed action on the Digital Asset Market CLARITY Act until September.

The CFTC said its crypto discussion will examine how regulators can use existing authority to provide greater clarity while Congress works on broader digital asset legislation. The committee will look at the development of crypto markets, overlapping federal and state jurisdictions, cybersecurity, market infrastructure and the regulation of crypto derivatives.

The development also brings the CFTC closer to the Securities and Exchange Commission (SEC) in the ongoing effort to build clearer crypto rules. The two agencies have already been working on regulatory coordination, and the CFTC’s agenda specifically considers how regulatory action can complement future congressional legislation.
The SEC has also been moving ahead despite the delay in the CLARITY Act. The agency had planned to consider a tailored regulatory framework for certain crypto investment contracts, although its scheduled August 13 meeting was cancelled because of an unexpected scheduling issue. The SEC has said it will continue working within its existing authority while supporting Congress’s efforts on market structure legislation.

The CFTC meeting will also examine prediction markets and disputes over federal and state jurisdiction, as well as the growing use of AI in trading, compliance, surveillance and risk management.
For the crypto industry, the developments suggest that US regulators may not wait for Congress to complete the CLARITY Act before taking steps within their existing powers. The broader legislation is still expected to return to the Senate after the August recess, with a key vote currently scheduled for September 15.
