South Korea To Ease Crypto Major Shareholder Reviews For Minor Legal Violations

South Korea’s Financial Services Commission (FSC) has announced plans to introduce exceptions to disqualification criteria for major shareholders of virtual asset service providers (VASPs), specifically for minor legal violations or those arising under joint penal provisions. The initiative, which was outlined in written answers sent to the National Assembly’s National Policy Committee, attempts to harmonize rules pertaining to the cryptocurrency industry with current financial market legislation.

The presidential Regulatory Rationalization Committee recommended easing significant shareholder eligibility checks, which prompted the FSC to make its judgment. In order to provide a more uniform regulatory framework across financial sectors, the new exceptions will replicate procedures previously established under the Capital Markets Act and the Online Investment-Linked Finance Act.

A new enforcement order of the Act on Reporting and Using Specified Financial Transaction Information is set to go into effect on August 20, making this amendment especially pertinent. Major VASP stockholders are subject to more stricter screening requirements as a result of this modification, which may exclude anyone who have even little offenses. The goal of the FSC’s new exemption is to avoid unduly severe consequences that would impede lawful company activities.

This regulatory subtlety is crucial for bitcoin exchanges and other VASPs that operate in South Korea. Only serious legal infractions will result in disqualification for major owners under the new, more open, and equitable review procedure. As investors’ expectations regarding regulatory obstacles become more explicit, this might promote investment and stability in the industry.

The shift reflects South Korea’s continued efforts to strike a compromise between the need to support a competitive cryptocurrency market and stringent anti-money laundering (AML) and consumer protection regulations. The FSC is also lowering regulatory arbitrage and establishing a more predictable environment for both domestic and foreign players by conforming to established financial rules.

The FSC’s explanation offers crucial direction for cryptocurrency companies managing shareholder eligibility as the August 20 enforcement decree draws near. The action is a practical step toward balanced regulation that will benefit the business and its stakeholders, even though the full extent of the exclusions is still to be determined.
