India’s Digital Act Plans Category-Wise Regulations For Online Intermediaries

According to reports, the upcoming Digital India Act will categorise various online intermediaries such as social media platforms, ecommerce, and fact-checking portals and issue specific regulations for each of these categories.

The government is also considering a departure from the long-standing concept of “intermediaries” with the upcoming Bill.

For Indian regulators, the concept of intermediaries is also novel. The new regulation will extend the existing standards for intermediaries to other online entities such as ecommerce portals and fact-checking platforms.

Rajeev Chandrasekhar, Minister of State (MoS) for Electronics and Information Technology, stated on December 9 that the draught Bill would be available for public comment by the end of the month.

The upcoming Bill will also include a regulator for the digital space as well as penalties for violating norms. It will also include provisions for governing emerging arenas like blockchain and the metaverse.
