Perpetual contracts have no expiry date and allow traders to have an unlimited position. The product allows traders to go up to 5x leveraged and trade 24/7. Features include take-profit and stop-loss orders and isolated margin, which limits loss on any individual position to the margin deposited for that trade.

Regulatory Structure: NFA, CFTC & FCM
The regulatory arrangement is structured so that Crypto.com is registered with the National Futures Association as an introducing broker. Trades are routed through OG.com’s CFTC-regulated designated contract market, derivatives clearing organization, and futures commission merchant.
This structure gives Crypto.com access to OG.com’s existing regulatory approvals rather than requiring Crypto.com to build and obtain all three registrations independently.
Nadex, OG.com’s options exchange, additionally registered with the SEC in September 2026 for security futures products, extending the potential scope of the partnership to equity-linked derivatives.
CFTC’s May 2026 Opening & Competitive Context
The CFTC’s May 2026 policy guidance marked the first time that crypto perpetuals were available on U.S. markets. Kalshi became the first to offer Bitcoin perpetuals under the new regulations, followed by Coinbase offering them under a no-action relief letter from the CFTC.
Then Kraken became the next to enter the market, launching their crypto perpetuals in June 2026 having completed their acquisition of Bitnomial futures exchange.
Crypto.com CEO Kris Marszalek added that he is currently working with the SEC and CFTC to bring single stock perpetual futures to the U.S. to allow people to trade perpetuals on individual stocks beyond just Bitcoin and Ethereum.
