Over the weekend, the likelihood of a Senate vote on the CLARITY Act before the August vacation decreased. According to Senate Democratic leaders’ official schedule, the chamber will meet on Monday, August 3 at 3:00 p.m. A cloture motion on a continuing resolution to finance the government (H.R. 6500), not the crypto market-structure measure, is the only roll-call vote scheduled for around 5:30 p.m. The Digital Asset Market CLARITY Act is not listed on Monday’s agenda.

Since the Senate will leave for its recess after the first week of August, there are only about 72 hours left for the bill to get attention on the floor. As of the current schedule, no cloture motion has been filed to begin the multi-day process needed for a floor vote.

The main schedule is clear about Monday’s plans. After the Senate meets and leaders make their remarks, the only scheduled vote is to invoke cloture on the motion to proceed with the continuing resolution, which is meant to keep the government funded. There is no time set aside for the CLARITY Act.

This is important for the process. To move a bill past a possible filibuster, the Senate must invoke cloture, which takes several days and includes time before and after the vote for debate. Since these steps have not started for the CLARITY Act and the recess is close, the schedule itself is now the main obstacle to the bill’s progress.

The CLARITY Act, officially H.R. 3633, would split U.S. oversight of digital assets between the Securities and Exchange Commission (SEC) and the Commodity Futures Trading Commission (CFTC), which the industry has wanted for some time. Decentralized finance and stablecoins are also covered under the law.

It advanced out of the Senate Banking Committee 15–9 in May 2026 after passing the House 294–134 in July 2025, but it has stalled in the Senate as a whole. With no floor time planned and no cloture motion filed, it is still on the Senate Legislative Calendar.
