Poland Probing OpenAI, ChatGPT
Poland’s Personal Data Protection Office (UODO) is investigating a complaint against OpenAI’s ChatGPT, accusing the firm of processing data in an unlawful and unreliable manner. The complaint alleges that ChatGPT generated false information about the applicant and failed to meet their demands for the exercise of rights under the European General Data Protection Regulation (GDPR). The UODO’s president, Jan Nowak, stated that this is not the first time doubts have been cast on ChatGPT’s compliance with European data protection and privacy principles.
OpenAI’s proposed proceedings against the company could be challenging due to its outside the European Union status. The case involves violations of personal data protection provisions, and UODO deputy president Jakub Groszkowski argues that the allegations raise doubts about OpenAI’s approach to Europe’s principles on personal data protection. UODO will clarify these doubts, particularly against the fundamental principle of privacy by design in the GDPR. This is not the first time OpenAI has violated European GDPR compliance.
